Investor Visas

Business Innovation and Investment (Provisional) Visa (subclass 188)

The Business Innovation and Investment (Provisional) visa (subclass 188) is part of the Business Innovation and Investment Program.

You must submit an Expression of Interest (EOI) through SkillSelect and be nominated by an eligible government organisation before being invited to apply for this visa.

Holding this visa is the first stage before becoming eligible to qualify for a Business Innovation and Investment (Permanent) visa (subclass 888).

This visa allows you to:

  • Own and manage a business in Australia (the Business Innovation stream).
  • Conduct business and investment activity in Australia (the Investor stream, the Significant Investor stream and the Premium Investor stream).
  • Undertake an entrepreneurial activity in Australia (Entrepreneur stream).
  • Establish a new or develop an existing business and/or invest in Australia, make a designated investment with an Australian state or territory government, make and maintain
  • complying investments in Australia or participate in a complying entrepreneurial activity in Australia.
  • Travel in and out of Australia for the life of your visa.
  • Bring members of your family unit with you to Australia.
  • Seek permanent residence by applying for a Business Innovation and Investment (Permanent) visa (subclass 888).

This visa includes five streams:

  • Business Innovation stream: for people with business skills who want to establish, develop and manage a new or existing business in Australia. Applicants must be nominated by
  • a state or territory government.
  • Investor stream: for people who want to make a designated investment of at least AUD 1.5 million in an Australian state or territory and maintain business and investment
  • activity in Australia. Applicants must be nominated by a state or territory government.
  • Significant Investor stream: for people who are willing to invest at least AUD 5 million into complying significant investments in Australia and want to maintain business and
  • investment activity in Australia. Applicants can be nominated by a state or territory government or Austrade on behalf of the Australian government.
  • Premium Investor stream: for people who are willing to invest at least AUD 15 million into complying premium investments in Australia and want to maintain business and
  • investment activity in Australia. Austrade will make the initial contact with suitable candidates for nomination on behalf of the Australian government.
  • Entrepreneur stream: for people who have a funding agreement from a third party for at least AUD 200,000 to undertake a complying entrepreneur activity that is proposed to
  • lead to either the commercialisation of a product or service in Australia or the development of a business in Australia. Applicants must be nominated by a state or territory government.

Business Innovation and Investment (Permanent) Visa (subclass 888)

The Business Innovation and Investment (Permanent) visa (subclass 888) is the second stage of the Business Innovation and Investment (Provisional) visa (subclass 188). You can apply for it after you have fulfilled the requirements of your provisional visa.

You do not need to submit a new Expression of Interest or be invited to apply for this visa. You need to be nominated by a state or territory government agency or Austrade on behalf of the Australian government if you are seeking to satisfy the primary criteria.

If you are the holder of a provisional Business Innovation and Investment visa (subclass 188) you should provide evidence that the government entity which nominated you for that visa has not withdrawn the nomination.

The Business Innovation and Investment (Permanent) visa (subclass 888) allows you to manage your business and investments in Australia.

This is a permanent residence visa. It lets you and any member of your family unit who has also been granted this visa:

  • Stay in Australia indefinitely.
  • Work and study in Australia.
  • Enrol in Medicare, Australia’s scheme for health-related care and expenses.
  • Apply for Australian citizenship (if you are eligible).
  • Sponsor eligible relatives for permanent residence.
  • Travel to and from Australia for five years from the date the visa is granted. After that time, you will need a resident return visa or another visa to return to Australia.

You must:

  • Hold a relevant stream of the subclass 188 visa or 444 visa.
  • Be nominated by a state or territory government agency or Austrade.
  • Have owned and operated a business in Australia for at least 2 years (Business Innovation stream) or
  • Have held a designated investment of AUD 1.5 million for 4 years (Investor stream) or
  • Have held a complying investment of AUD 5 million for 4 years (Significant Investor stream) or
  • Held a complying investment of AUD 15 million for 1 year (Premium Investor stream).
  • Meet additional financial and other requirements of the same stream of this visa.

Business Talent (Permanent) Visa (subclass 132)

The Business Talent visa (subclass 132) is for business people who are nominated by an Australian state or territory government agency. To be able to get this visa you need to submit an Expression of Interest (EOI) through SkillSelect and then be invited to apply.

This visa allows you to establish a new or develop an existing business in Australia. It has two streams:

  • Significant Business History stream: for high-calibre business owners or part-owners who want to do business in Australia.
  • Venture Capital Entrepreneur stream: for people who have sourced venture capital funding from a member of the Australian Venture Capital Association Limited (AVCAL).

This is a permanent residence visa. It lets you and any member of your family unit who has also been granted this visa to:

  • Stay in Australia indefinitely.
  • Work and study in Australia.
  • Enrol in Medicare, Australia’s scheme for health-related care and expenses.
  • Apply for Australian citizenship (if you are eligible).
  • Sponsor eligible relatives for permanent residence.
  • Travel to and from Australia for five years from the date the visa is granted. After that time, you will need a resident return visa or another visa to return to Australia.

You might be able to get this visa if:

  • You are nominated by a state or territory government.
  • Are invited to apply.
  • You and your family members (whether or not they are included in your application) meet health and character requirements.
  • You meet the additional requirements for the stream in which you apply.

Business and Innovation Stream
This visa is for successful business owners or investors from overseas who are willing to do one of the following:
– Invest in new or existing businesses in Australia
– Make designated investment in Australian State or Territory government bonds

Investor Stream
For this stream, you’ll be able to stay in Australia for up to five years.
You must be nominated by a state or territory government agency to invest at least:
– AUD $2.5 million (if you meet certain requirements and you were invited to apply on or after 1 July 2021)
– AUD $1.5 million (if you are in an Australian State or Territory and if you were invited to apply before 1 July 2021)

Significant Investor Stream
This is for people who:
– Are willing to invest at least AUD$5 million into Australian investments (which meet certain criteria)
– Want to maintain business and investment activity in Australia Applicants can be nominated by a state or territory government, or Austrade on behalf of the Australian government.

Premium Investor
This is for people who are willing to invest at least AUD $15 million into complying premium investments in Australia. They must:
– Want to maintain business and investment activity in Australia
– Be nominated by Austrade on behalf of the Australian government

Entrepreneur Stream
This is for people who have a funding agreement from a third party (for at least AUD $200,000) to undertake entrepreneurial activity that’s proposed to lead to either the commercialisation of a product or service in Australia, or the development of a business in Australia.
The entrepreneurial activity must meet certain criteria and applicants must be nominated by a state or territory government.

Business Innovation and Investment (Permanent)
This visa is the second stage of the Business Innovation and Investment visa.
You can apply for this 888 permanent visa after holding the 188 provisional visa either for two years in the business innovation stream or four years in the investor stream. You must have met all prescribed criteria.

Excluding all the investment funds required for each visa, the fees payable to the Department of Home Affairs depend on the state or territory you have been nominated by.

The processing time varies on a number of factors.
No specific timeframe has been provided by the Department of Home Affairs for business visa applications.
