Other Visas

Protection visa (subclass 866)

This visa falls under the subclass 866, it is meant for people who engage Australia’s protection obligations either because they are a refugee or they meet the protection criteria under the Migration Act 1958. To engage in Australia’s protection obligations you need to be a refugee.

To be a refugee in Australia, an asylum seeker must be assessed as meeting certain legal criteria. The meaning of a ‘refugee’ in the Migration Act 1958 (the Act) is a person in Australia who is:

  • Outside their country of nationality or former habitual residence (their home country) and
  • Owing to a ‘well-founded fear of persecution’, is unable or unwilling to return to their home country or to seek the protection of that country.

You and any eligible family members must be in Australia when you apply for this visa.

This Visa allows you to:

  • Reside in Australia on an indefinite basis
  • Work in Australia as a permanent resident
  • Apply for Australian Medicare
